Important: Notice about Documentation necessary to travel, Cancellations, Refund, Cancellation Insurance, Reconfirmations, Form of payment and Changes of Names.

. Documents necessary for travel: It is the responsibility of the passenger to have the necessary documents for travel. Foreign passengers can use their NIE to obtain electronic tickets, but to travel it is compulsory to have a passport or another document, accepted as valid for travelling, by the airline companies and authorities. The NIE alone is not sufficient.
. Cancellations: Reservations are final and Terminal A issues any reserved tickets. Once the reservation has been made Terminal A does not cancel tickets automatically. The tickets will be issued when the credit cards or the transfer payment has been accepted. In case of not being able to travel, you will have to request a refund, or you can use the cancellation insurance if you have selected it. To recover your money in unforeseen cases, we recommend the use of the cancellation insurance group Elvia-Grupo Mondial Assistance, where possible.
. Refunds: Refunds are provided by the airline companies and they are subject to the fare conditions. The most economical or “tourist with restrictions” fares (identified on the website as: “CHANGE/REFUND RESTRICTED”) often DO NOT have refunds. In such cases Terminal A recommends the use of the cancellation insurance group Elvia-Grupo Mondial Assistance, where possible. Terminal A charges a service fee of 15 EUR for processing refunds in addition to the charge that has been establish by the airline.

Changes of Passenger Names: When making a change in the name of one or more passengers on a reservation, you may lose the originally desired fare. Changes in names usually require the cancellation of the original booking and a new booking will have to be made. Therefore it is important to write the names and surnames of the passengers on the reservation correctly to ensure the fare of the reservation and avoid costs of refunds and new bookings. The majority of the airline companies that allow a change of the passenger names require the cancellation of tickets with incorrect passenger names, requesting the corresponding refund and the issuing of new tickets. Terminal A charges a service fee of 150 EUR for processing any name change.

Process for changes and cancellations of tickets purchased through Terminal A: In order to alter a reservation, irrespective of reason, it is absolutely necessary to inform us of this via e-mail at cambios@terminala.com. Once your e-mail has been received, the department will offer you any available alternatives. The same process is also applied for cancellations, but in this case the e-mail will have to be sent to cancelaciones@terminala.com.

Important Note: Please do not contact the aforementioned departments with regards to fare penalties. If you need any such information, please contact our call centre at 0034 93 645 50 18, or e-mail us at acliente@terminala.com. Any requests for changes and cancellations will only be attended to during our working hours.
. Cancellation Insurance: Terminal A and the Elvia-Grupo Mondial Assistance group offer you the possibility to purchase cancellation insurance. We recommend that you purchase this if you wish to be covered in case of illness, loss of work or other unforeseen cases. The Cancellation Insurance allows you to recover the compensation sooner than similar policies offered by some airline companies which can take several months to be processed. . Reconfirmation of Flights: It is important to confirm your flight 24 hours before your departure. You may do this by contacting the airline company or visiting http://www.viewtrip.com (for reservations processed with Galileo) or http://www.checkmytrip.com (for reservations processed with Amadeus). Please be aware departure times may be changed by the airline companies up until the last moment.
. Payment Methods: We recommend payment with a credit or debit card. If you choose to pay via a bank transfer it is your own responsibility to perform said transfer and fax us the receipt to: 0034 93 520 70 99. Terminal A will not issue tickets if the bank transfer or respective confirmation has not been received..
. Our Passenger Group Conditions: Airline companies define a group as a reservation with a minimum of 10 passengers (excluding children under 2). Each passenger must have an identical flight itinerary. On group reservations special fares are applied, subject to space availability and approval by the airline. Airlines have the right to deny such fares for any reason they deem appropriate. Terminal A offers a special service for groups through e-mail at grupos@terminala.com.
. Conditions of Roundtrip Fares: Fares of roundtrips offered by Terminal A that entail a single airline can be cancelled if the passenger does not use the outbound flight. To avoid this type of problem the client must call our customer service on: 0034 93 645 50 18 to enquire about possible alternatives. However the airlines ultimately decide upon guaranteeing the seat on the return flight of the reservation.
. Fuel: The air companies can increase fuel taxes without notice. This rise may in some cases increase the final price of the ticket. Such decisions are made solely by the airline, and are independent of Terminal A.
. Unaccompanied Minors: The airlines companies, regular or low cost, have strict guidelines for reservations with unaccompanied minors. Unaccompanied minors are defined as children above the age of 12, although some companies have alternative age restrictions. To avoid problems from these types of reservations, you must e-mail the following address in order to make a reservation with the appropriate details: menores@terminala.com. Once we have received the e-mail our customer service department will contact you to request the information needed to confirm the reservation.

The www.terminala.com website (from now on the “Website”) belongs to Centro de viajes Terminal A S.L., a partnership located in Paseo Ferrocarril nº 335 bajos 1ª, 08860 Castelldefels (Spain), Tax ID B 63062012 (from now on “Terminal A”). Through Terminal A, users (from now on the “Users”) will be able to obtain varied information about trips and tourism.
In order to use this site, the User expressly accepts fully adhesion and no objections to each and every General Condition published by Terminal A the moment the User visits this site, especially the established conditions about the limited liability both of Terminal A and any tourism or travel services supplier. Hence the User must read the General Conditions carefully every time he visits the site, because these conditions may have been modified since the last time he entered the site.
The User declares to be full age and has the legal ability to acquire the services offered by the Terminal A Website.

| SERVICES HIRING THROUGH THE TERMINAL A WEBSITE |
TERMINALA exploits this Website and particularly provides its contents, products and services to the Users of this site on their behalf and the formalization of reservations of any flight, car, combined trips and hotel, which are made by Terminal A Tours (retailer and wholesaler travel agency). Terminal A’s headquarters are located in Paseo Ferrocarril nº 335 bajos 1ª, 08860 Castelldefels (Spain), from now on “Travel Agency”.
These General Conditions apply to every sale or service depicted in our booklets, price lists, advertisements and budgets, both oral or through Internet. Any modification will be confirmed by Terminal A in writing. Other terms or conditions are excluded. Your reservation or order involves the acceptance of these general conditions.
Car reservation hiring is directly made by AVIS RENT-A-CAR Corporation (“AVIS”). Terminal A only includes AVIS reservation service in a frame that can be accessed through the Website. Unless otherwise stated, under no circumstances are you to understand that TERMINAL A offers flights, car rental services, combined trips, hotel and bus reservation and tourism services (or similar) directly.
Users must know that the hiring of services above mentioned is ruled by specific contractual conditions, (according to the legislation that can be applied in each case) which must be agreed among the Users, the services supplier and the Travel Agency.
Specially the following conditions will always apply:

| 1. Terminal A’s limitation of liability. |
The acceptance of the following limitation of liability is essential for Terminal A to issue and send air tickets. That is why as regards the air ticket issuance and delivery services (purchased through the Website), the maximum liability assumed by Terminal A is:
- Making and managing air ticket delivery
- Making reservations, including the supply of certain tariffs.
It can never be greater than the amount of the offered ticket (including management and delivery fees which in that case would be charged to the user) plus 20%, so if there’s negligence from Terminal A in any of the activities above mentioned, its maximum responsibility will be limited to the said amount. Also under no circumstances is Terminal A to be responsible for lost profits stemming from a negligent transaction.

| 2. Air Tickets
|

| TICKET ISSUANCE COMMISSION
|
From February 13, 2006, Terminal A will charge the following amounts, taxes included, for each ticket in purchases from regular airline companies:

12 € per electronic ticket

12 € per physical ticket
Notwithstanding the tariff selected by the user, this amount will not be reimbursable. It will be applied again if changes are made, if the tariff allows it (except for those cases where it is not required by the buyer).

| NOTICE
|
If the passenger’s trip ends or has a stop in a country other than the country of departure the Warsaw Convention can be applied and in most cases limiting the liability of carriers for death or personal injury and for baggage loss or damage. See also the notice called "Notice to International Passengers about Limitation of Liability” and "Notice about limitation of Liability for baggage."

| CONTRACT CONDITIONS
|
- For purposes of this contract “ticket” means the ticket and the baggage check, of which the present conditions and notices form part; “carrier” means every air carrier that transports or undertakes to transport the passenger or his baggage hereunder or renders any other service related to such air transport; “WARSAW CONVENTION” means the Convention for the Unification of Certain Rules relating to International Air Transport, signed at Warsaw, on October 12, 1929, or that Convention as amended at The Hague, on September 28, 1955, whichever may be applicable.
- Transport hereunder is subject to the rules and limitations relating to liability established by the Warsaw Convention unless such transport is not “international transport” as defined by that Convention.
- To the extent not in conflict with the foregoing, transport and other services rendered by each carrier are subject to: (1) provisions contained in the ticket, (2) applicable fees, (3) transport conditions established by the carrier and related regulations which are made part hereof (and can be consulted at the carrier’s offices), except for transport between a place in the United States or Canada and any place outside such countries to which the rules in force in those countries will apply.
- Carrier’s name may be abbreviated in the ticket, as long as the full name and its abbreviation appear in the carrier’s manuals, conditions, regulations or timetables. The Carrier’s address shall be that of the departure airport written on the ticket in front of the first abbreviation of the carrier’s name. The set stops are those places set forth in this ticket or shown in the carrier’s timetables as stops already scheduled on the passenger’s itinerary. The transport to be performed hereunder by several successive carriers is regarded as a single operation.
- A carrier issuing a ticket for other carrier lines acts only as its agent.
- Any exclusion or limitation of the carrier’s liability shall apply to and benefit its agents, employees and representatives and any person whose aircraft is used by the carrier for transport and its agents, employees and representatives
- Checked baggage will be delivered to the bearer of the baggage check. In case of damaged baggage moving in international transport, a complaint must be submitted in writing to the carrier immediately after discovering the damage and, at least, within seven days after the delivery date. In case of delay, the complaint must be submitted within twenty one days after the day when the baggage was delivered. See the manuals or conditions applicable transport that is not international.
- This ticket is valid for one year from the date of issuance, unless otherwise stated on the ticket itself, on the carrier’s tariff manuals, transport conditions, or applicable regulations. The tariff for the transport hereunder is subject to modification before beginning the trip. The Carrier may refuse to carry out the transport if the applicable tariff hasn't been paid.
- Carrier undertakes to do his best in order to transport the passenger and baggage with reasonable dispatch. Times shown in timetables or elsewhere are not guaranteed and are not part of this contract. The carrier may be replaced without notice by alternate carriers, or it may use other aircrafts, and modify or eliminate stops that were foreseen in the ticket, if necessary. Timetables are subject to change without notice. The carrier bears no responsibility for guaranteeing connections.
- The passenger must comply with Government travel requirements and show departure, arrival and other required documents and arrive at the airport at the time determined by the carrier. If no specific time was determined, the passenger must arrive early enough to follow departure procedures. We suggest you arrive 90 minutes earlier for domestic flights and 150 minutes earlier for international flights, especially if the flight has a stop in the United States or if the United States is its destination. If the origin or destination airport is the Air Terminal 4, of Madrid Airport, you must add 60 more minutes.
- No agent, employee or representative of the carrier has the authority to alter, modify or waive any provision of this contract.
The passenger must reconfirm the timetable with the airline company 48 hours before departure, since the airline company may modify it.
NOTE: For Spanish domestic traffic, the carrier’s liability is limited according to Aerial Navigation Law of July 21, 1960 and Real Decree 2333/1983 of August 4.

| 3. COMBINED TRIPS: |
The hiring of Combined Trips is subjected to Law 21/1995 of Combined Trips and the specific conditions agreed with the Users according to wholesaler who plans the combined trip. Terminal A is a retailer agency.

| 4. LACK OF PAYMENT AND PAYMENT REFUND
|
Since Terminal A acts as a broker in the payment of booked tickets and its unique ticket sale margin of profit is its management fee, Terminal A is compelled to pursue debtors.
If the reservations made by transfer are not paid or the legible copy of the bank transfer is not sent within business hours, the tickets won’t be issued and the reservation could be cancelled with no further notice.
If the credit card is rejected at the moment of payment due to any error including a simple mistake while entering the credit card numbers, your reservation could be cancelled with no further notice.
In case of reimbursing you for the complete or partial payment of the charges made on your credit card, if you chose this form of payment or if the bank transfer is cancelled in case you chose this form of payment, due to the fact that Terminal A would have automatically issued an paid the booked tickets, a 250€ claim commission for lack of payment will be automatically accrued in Terminal A’s favor, for each charge that was rejected, cancelled or reimbursed with no further notice. If the debtor is taken to court, he will have to pay all the claim associated expenses such as taxes, attorney’s and lawyer’s fees (even when his intervention is not preceptive), travel expenses, daily stipend etc.

| 5. ADDITIONAL INFORMATION
|
The passengers claim to know and meet all the Government requirements as regards departure and arrival documents. All this information can be found in the Website (Travel Guide) and for the Spanish it is available in the web page of the Spanish Ministry of Foreign Affairs (www.mae.es). In case of doubt, we suggest you contact our Customer Service at 93 633 6280, before making any purchase.
From the October 26, 2004, only Spanish citizens who have a Spanish passport of mechanic reading will be able to travel to the United States (including flights which have stops in that country) without a visa within the Visa Waiver Program.
The budgets or price offers will only be valid for the term denoted by them. If no term is denoted, it will be up to 24:00 hours of the ongoing day. The orders or reservations will be accepted through Internet by means of the order confirmation by phone or fax, and will only be binding once accepted by Terminal A through the Order or Reservation Confirmation within 24 hours after the order was made. The User must check the Confirmation and notify any mistake immediately, if necessary, by e-mail or fax or otherwise, 24 hours after the confirmation is issued by terminal A, the information stipulated in the confirmation will be definitely applicable to the order or reservation.
The respect for the payment term is essential to the improvement of the contractual operation. Terminal A can freely suspend the order or reservation or the delivery of the trip documentation until the payment of the order or reservation is completed; it can even cancel the reservation if it is impossible or inconvenient to keep it in force until the order or reservation payment is completed. The acceptance of other forms of payment other than the credit card is left to the discretion of Terminal A.
The purchase of any product will only become effective when Terminal A makes the total charge to the given credit card in a valid way or 24 hours after receiving a fax with the receipt that denotes that the bank transfer has been made correctly for the total amount of the purchase, in case of a transaction authorized by bank transfer. Up to that moment, Terminal A can cancel the order or reservation.
A reservation request implies the client’s commitment to authorize the charge to the credit card which he is providing. Were not possible to make the charge to the credit card (rejected transaction), the client must know that:
To proceed with the ticket(s) delivery to the address specified by the client in the reservation, the payment of the plane ticket(s) must be made with a credit card before issuing the ticket(s).
The prices specified online include the airport taxes. The visa expenses and the departure taxes are not included. These can be paid in local currency or US dollars. The client will be subject to tariff variations that may apply because of a delay in paying the reservation to the airport taxes amount from the moment the reservation is made until the issuance of the tickets.
Delivery of trip documentation:
Terminal A will act with proper diligence in order to provide the courier company with all the trip documentation requested by the User during the following 72 hours. Even if it is possible that such delivery can’t be made due to problems beyond its control, Terminal A will make every effort to make the delivery before the beginning of the trip. The maximum information size in the delivery address is 4 lines with 25 characters; within that space the User must enter all the necessary information for the delivery to be made. Terminal A can not guarantee the delivery if there isn’t detailed information about the delivery within the specified limits. Terminal A is not responsible for delays (delivery or service included) caused by circumstances beyond its control, and will have the right to overtime for its execution. Examples of these circumstances, without limitative nature, include strikes, terrorist acts, war, transport, provision or production problems, currency exchange fluctuations, government action and natural disasters.
Terminal A will charge 7.50€ for delivering physical tickets to the address indicated by you at the moment of making the reservation. There must be somebody at the indicated address to receive the documentation, as the courier company only makes hand-deliveries. If the Client wants to receive his physical tickets at an address outside Spain, Terminal A will charge him the courier company expenses, taking into account the fact that the price of such delivery may vary according to the destination.
Consumers rights:
Pursuant to what was established by Decree 168/1994 art.18 of the Catalunya Travel Agency Regulations on May 30, consumers who make a reservation or an order, or purchase any products through the Terminal A Website can cancel their purchase, order or reservation and will have the right to receive a refund for the amounts paid by him, but he must compensate Terminal A for the management fees specified under the general conditions of Terminal A and dully justified cancellation fees. In case Terminal A has already paid for the tickets that were requested, booked or purchased, and the companies or service rendering entities do not authorize a refund, the consumer must compensate 100% of the trip total payment, even if he doesn’t use the tickets for any cause whatsoever.

The website displays are optimized for use with the Internet Explorer browser under Windows Operating System. Terminal A is not responsible for the results obtained using a different browser or operating system.

|
The information within the website is offered for the Users’ convenience, though this information can have inaccuracies, misprints or any other kind of mistakes. TERMINAL A does not guarantee the accuracy or reliability of the information or website contents. Users will use the website only for private use.
Users can’t in any way copy, reproduce, transmit or distribute the contents of this website or of the services that can be obtained through this site without TERMINAL A’s written permission.
Users and generally any person who is determined to establish a link between any website and any of the web pages of the Website (from now on, the “Link”) won’t be able to do so if there isn’t a logo, a Website advertising bar or any other element identifying TERMINAL A as the owner of this Website. The Website can’t be included as part of another website.

The conditions hereof are subject to Spanish legislation and the contracts will be signed at Terminal A’s legal address. The courts determined by law pursuant to general or special rules that set the competence will be competent to carry out any lawsuit that may derive
from the conditions hereof.
If any provision in this contract were claimed by a Court as invalid or inapplicable, the remaining provisions won’t be affected. Terminal A can completely or partially subcontract, transfer or grant its obligations or rights to a third party.
