Privacy Privacy at www.terminalA.com By virtue of the applicable rules as regards Personal Data Protection, Centro de Viajes Terminal A S.L. located in Paseo Ferrocarril nº 335, bajos 1ª , Castelldefels city (08860), Barcelona province, Spain (from now on, Terminal A) states that when browsing through www.terminala.com or www.terminala.es or when making a purchase, it is necessary to provide specific Personal Data that will be handled automatically and will be part of the corresponding automatic files, previously registered before the relevant authority. Terminal A will be the owner of and responsible for that data. The answers to questions about Personal Data marked with an asterisk (*) are mandatory. If the user fails to answer them, he won’t be able to continue or conclude the purchase or reservation procedure. The purpose of gathering and automatically processing Personal Data is to maintain the contractual relationship established with Terminal A and the purchase, reservation, consultation and issuance management of every type of travel tickets or vouchers – management, administration, improvement and adaptation according to the products and services taste and preference- and also the delivery (by traditional and/or electronic means) of administrative, technical, organizational and/or commercial information about the products and services offered by or that can be offered by Terminal A. The provision of all the data that is required to hire the service on the part of the CLIENT is mandatory, and Terminal A has the right to deny registration to the person who does not provide that data. The data owner expressly authorizes Terminal A to transfer the information to the companies of its corporate group and their subsidiaries for the processing of the data authorized by the User, as well as other entities to whom it may be necessary to transfer that data for rendering the service subscribed by the Terminal A user or for carrying out the usage authorized by him according to the conditions hereof. Terminal A can, and even should, transfer Personal Data to other companies with the same aim that have been indicated in the above paragraph. The owner of the data expressly authorizes the transfer or communication of the data included in the file above mentioned referring to those companies. Terminal A guarantees to safeguard the confidentiality and safety of Personal Data in the international data transfer that can be carried out. However, depending on their destination, reservation or purchase, we specially warn you that your personal data shall be transferred in order to make your reservation or purchase to companies from countries or nationalities that do not guarantee the safety of your data because it is not a requirement of their specific legislation. The purchase, reservation or consultation about trips, tickets or vouchers made to these companies imply your express consent to transfer the required data in order to make your purchase, consultation or reservation. The owner of the data will always have the right to access the automatic files. He will be able to exercise the rights of rectification, cancellation and opposition according to the terms of the data protection legislation; and he is able to revoke his consent to process and transfer his personal data. To that end, he must address a letter signed by the owner of the data to TERMINALA.COM legal address in Castelldefels, Paseo Ferrocarril nº 335 bajos 1ª , 08860, province of Barcelona. The letter must contain his address and an attached copy of his ID Booklet or passport. Also, in accordance with the 2001 agreement between the European Commission and the Customs Authorities of the United States of America about Aerial and Transportation Security, the CLIENT who makes plane ticket reservations with destination or stop in USA, expressly authorizes Terminal A to transfer the personal data provided by him to de Customs Authorities of the United States in order to improve aerial transport safety. Terminal A has adopted the legally demanded security measures in its facilities, systems and files. It guarantees the confidentiality of the Personal Data, even though it will be revealed to the competent public authorities, as well as any other information that is under its domains or that can be accessed through its systems and can be required according to the legal and regulatory resolutions that are applicable. The Users guarantee and respond, whatever the case, to the veracity, accuracy, validity, authenticity, pertinence and non excess of the Personal Data provided by them and they are committed to keep that data properly updated. NOTICE ABOUT THE TRANSACTIONS IN THE WWTE WINDOW (OPT-IN) FOR HOTELS AND CAR RENTAL The CLIENT who records, makes consulattions, books, purchases or hires hotels, car rental, vacation packages or any other product through the Travelscape.com, Inc dba WWTE website (properly identified by the URL web page the client is browsing at all times, though the header shows the Terminal A banner), will be specially informed that he is accessing the Travelscape.com, Inc dba WWTE website though the visual environment is similar or almost exactly like the Terminal A website, and therefore the customer is leaving the Terminal A web page. From that moment on, the CLIENT WILL BE DIRECTLY IN CONTACT WITH Travelscape.com, Inc dba WWTE and will be registered or will be making any consultation, reservation, purchase or rental by hiring WWTE only, to whom he will transfer his personal data so that it can execute the operation(s) already mentioned or render the services hired by him. This way he will be specifically entering the privacy policy of Travelscape.com, Inc. dba WWTE, which is an American company not affected by the Spanish and European regulations regarding the privacy of personal data. The customer expressly authorizes the delivery of his personal data to the above mentioned company, which will be responsible for the file (Data Controller) under its privacy policy of personal data. The CLIENT who is registered and makes consultations, books, purchases or hires hotels, car rental, vacation packages or any other product through the Travelscape.com, Inc dba WWTE website can authorize or prohibit the transfer of all his personal data to Terminal A, this way he will be part of Terminal A database of clients or registered users for commercial and advertising purposes, accepting to receive news and offers though e-mails. In that case, the client will be registered in Terminal A’s customer files and will be subject to Terminal A’s general private policy. VISIT RECORDS TerminalA.com informs the user that an I.P. number will be assigned to him when accessing the TerminalA.com server. This number will record not only the client’s access to the server but also all the TerminalA pages visited by the client. The I.P. number will be stored in a LOG file that will be subject to TerminalA.com processing in order to determine the number of pages in the TerminalA.com net that were visited and also to collect statistics. USE OF "COOKIES" In order to speed up the service, Terminal A will use cookies, identifying each user in the fastest way. The cookies are blocks of data that some websites send to the computer’s hard drive when it is connected in order to identify it, and that information will be stored on the client’s hard drive. One of them is to ensure greater speed and service customization for the user, as well as the analysis of data supplied by the cookies record concerning traffic and audience rates and TerminalA.com users’ habits. The gathering of all this information is aimed to contribute to the evaluation and review of the services and products offered to the user by TerminalA.com and also the TerminalA.com users’ acceptance of the contents and designs of TerminalA.com web pages. CONTROVERSY RESOLUTION The parties with full waiver to their own privilege will accept the Spanish legislation as the governing legislation hereof and will subdue to the resolution of every lawsuit that could derive from this Agreement to the Courts of Barcelona.
